Terms of Use

By accessing or using University Apartments ("the Platform"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and University Apartments.

If you do not agree to these Terms, do not access or use the Platform.

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

The following definitions apply throughout these Terms of Use:

4.1 What We Provide

University Apartments provides the following services through the Platform:

• •Online marketplace connecting students and housing seekers with property owners, managers, and agents
• •Property search, filtering, and comparison tools
• •Interactive map-based property discovery
• •Property inquiry submission system
• •Roommate matching and profiling tools
• •University and city housing guides
• •Blog content about student housing and relocation
• •Saved searches, favorites, and property alerts
• •User dashboard for managing inquiries, favorites, reviews, and settings

4.2 What We Do NOT Provide

5.1 Registration

• •You must provide accurate, current, and complete information during registration.
• •Only one account per person is permitted.
• •Account types include: student, professional, agent, and landlord.
• •Email verification is required to activate your account.
• •Social login is available (Google, Facebook) and is subject to their respective terms of service.

5.2 Account Security

• •You are responsible for maintaining the confidentiality of your password and account credentials.
• •You must notify us immediately of any unauthorized access to or use of your account.
• •We are not liable for any losses resulting from unauthorized use of your account.

5.3 Account Suspension and Termination

• •We reserve the right to suspend or terminate accounts that violate these Terms.
• •You may delete your account at any time via your account settings.
• •Upon account deletion, your data will be handled in accordance with our data retention policy (see our Privacy Policy).

6.1 User-Generated Content

You may submit content to the Platform, including property reviews, agent reviews, roommate profiles, blog comments, contact messages, and property inquiries.

• •You retain ownership of your User Content.
• •By submitting User Content, you grant University Apartments a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute the content for Platform purposes.
• •We may remove User Content at our sole discretion without prior notice.
• •User Content may be subject to moderation before publication.

6.2 Content Standards

All User Content must:

• •Be accurate and not misleading
• •Not be defamatory, obscene, hateful, or discriminatory
• •Not infringe third-party intellectual property rights
• •Not violate fair housing laws
• •Not contain personal information of third parties without their consent
• •Not contain spam, advertising, or unsolicited promotional material

6.3 Prohibited Conduct

You agree not to engage in any of the following:

• •Using the Platform for any unlawful purpose
• •Posting false, misleading, or fraudulent listings, reviews, or information
• •Scraping, crawling, or automated data collection without prior written permission
• •Attempting unauthorized access to our systems, accounts, or data
• •Interfering with or disrupting Platform infrastructure or servers
• •Circumventing security measures, rate limits, or CAPTCHA protections
• •Impersonating another person, user, or entity
• •Sending unsolicited messages or spam through Platform messaging
• •Discriminating based on protected characteristics (race, color, religion, sex, national origin, disability, familial status) per the Fair Housing Act
• •Reverse engineering, decompiling, or disassembling Platform software
• •Creating derivative works from Platform content without permission

7.1 Listing Accuracy Disclaimer

Property listings on the Platform are provided by third-party landlords, property managers, and agents.

• •We do not verify rental prices, availability, descriptions, photos, amenities, floor plans, or other listing details.
• •Availability and pricing are subject to change without notice.
• •Photos may not reflect the current condition of a property.
• •Users should independently verify all listing information before entering into any agreement.

7.2 No Agency Relationship

• •We do not act as agent for any landlord, property manager, or tenant.
• •Submitting an inquiry through the Platform does not create a binding obligation on any party.
• •All negotiations and agreements are solely between tenants and landlords/agents.
• •We are not responsible for the performance or non-performance of any party to a transaction.

7.3 Fair Housing

• •We comply with the United States Fair Housing Act and equivalent state and local laws.
• •All listings and Platform use must comply with fair housing requirements.
• •Report discriminatory listings via our contact form.

8.1 Our Intellectual Property

The Platform design, code, logos, trademarks, text, images, and compilations are owned by University Apartments and are protected by United States and international copyright, trademark, and intellectual property laws.

• •"University Apartments" name and logo are trademarks of University Apartments.
• •No reproduction, distribution, or creation of derivative works is permitted without our prior written consent.

8.2 Third-Party Intellectual Property

• •Map data is subject to Mapbox Terms of Service.
• •Property listing photos are owned by their respective submitters.
• •University names and logos are trademarks of their respective institutions.

8.3 DMCA / Copyright Takedown

We respect intellectual property rights. To report copyright infringement, send a written notice to our designated agent containing:

• •Identification of the copyrighted work claimed to be infringed
• •Identification of the material that is claimed to be infringing and its location on the Platform
• •Your contact information
• •A statement that you have a good-faith belief that the use is not authorized
• •A statement, under penalty of perjury, that the information in the notice is accurate
• •Your physical or electronic signature

We maintain a counter-notification process and a repeat infringer policy in accordance with the DMCA.

• •Currently, University Apartments does not charge fees for basic Platform use, including searching, saving properties, and submitting inquiries.
• •Landlord and agent listing packages may be offered in the future.
• •If payment processing is introduced, applicable terms will be disclosed at the point of transaction.
• •We do not store full payment card details on our servers.
• •We reserve the right to introduce, modify, or discontinue fees with reasonable notice to affected users.

• •Currently, we do not use AI for automated decision-making that significantly affects users.
• •If AI-powered features are introduced (such as property recommendations, chatbot assistants, or similar tools), users will be informed.
• •Any AI-generated output is provided for informational purposes only and does not constitute professional advice.
• •Users should independently verify any AI-generated information before relying on it.

The Platform integrates with the following third-party services:

• •Mapbox — interactive maps and geolocation
• •Google / Facebook — social authentication
• •PostHog — product analytics
• •Cloudflare — security and performance
• •SendGrid — transactional email

Use of these third-party services is subject to their respective terms of service and privacy policies.

The Platform may contain links to external websites, including property owner sites and university sites. We are not responsible for the content, practices, or privacy policies of third-party websites. Inclusion of a link does not imply endorsement by University Apartments.

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

We make NO WARRANTIES, express or implied, including but not limited to:

• •Merchantability
• •Fitness for a particular purpose
• •Non-infringement
• •Accuracy or reliability of listings
• •Uninterrupted or error-free operation

We do not warrant that:

• •Listings are current or accurate
• •Properties meet any particular standard or condition
• •Landlords or agents are licensed or reputable
• •Search results are comprehensive

You rely on information provided through the Platform at your own risk.

To the maximum extent permitted by applicable law, University Apartments and its officers, directors, employees, agents, and affiliates shall NOT be liable for:

• •Indirect, incidental, special, consequential, or punitive damages
• •Loss of profits, data, goodwill, or other intangible losses
• •Damages arising from reliance on listing information
• •Disputes between you and landlords, agents, or roommates
• •Unauthorized access to your account
• •Service interruptions or outages
• •Third-party conduct on or off the Platform
• •Conditions, safety, legality, or suitability of any property

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless University Apartments and its officers, directors, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• •Your violation of these Terms
• •Your use of the Platform
• •User Content you submit
• •Your violation of any applicable law or third-party rights
• •Disputes between you and landlords, agents, or roommates

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense.

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before initiating formal proceedings, both parties agree to attempt to resolve any dispute informally. Please contact us at support@universityapartments.com. The parties shall engage in good-faith negotiations for a period of 30 days before pursuing formal dispute resolution.

15.3 Binding Arbitration

Any dispute not resolved through informal negotiation shall be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Either party may bring individual claims in small claims court if the claim qualifies under that court's jurisdictional limits.

15.6 Time Limitation

Any claim arising out of or relating to these Terms or the Platform must be brought within one (1) year of the event giving rise to the claim, or it shall be permanently barred.

University Apartments shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to:

• •Natural disasters, pandemics, or epidemics
• •Acts of war, terrorism, or civil unrest
• •Government actions, regulations, or embargoes
• •Internet or telecommunications failures
• •Power outages or cyberattacks
• •Third-party service provider failures
• •Strikes or labor disputes

We will make reasonable efforts to resume normal performance as soon as practicable after the cessation of such events.

• •We reserve the right to modify these Terms at any time.
• •Material changes will be communicated via email and a prominent banner on the Platform.
• •The "Last updated" date at the top of this page will be revised accordingly.
• •Continued use of the Platform after 30 days from notification of material changes constitutes acceptance of the modified Terms.
• •If you disagree with the changes, you should stop using the Platform and delete your account.
• •Non-material changes are effective immediately upon posting.

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and University Apartments regarding your use of the Platform.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

18.4 Assignment

We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer your rights or obligations without our prior written consent.

18.5 Notices

Notices to you may be sent via email or Platform notification. Notices to us should be sent to legal@universityapartments.com.

18.6 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

18.7 No Third-Party Beneficiaries

These Terms do not create any rights for third parties. No person or entity other than you and University Apartments has any rights under these Terms.

18.8 Electronic Communications

You consent to receive communications from University Apartments electronically. Electronic communications satisfy any legal requirement that such communications be in writing.
